Welcome to SahkaarX, a platform operated by Tntra-Takshshila Techlabs Pvt Ltd ("Company", "we", "our", or "us").
These Terms of Use govern access to and use of the SahkaarX learner application and related services that help you explore careers, assess skills, and follow personalized learning plans.
1. Acceptance
By creating an account, signing in, or continuing to use SahkaarX, you agree to these Terms of Use, our Privacy Policy, AI Usage Policy, and any other policies we present for acceptance in the application. If you do not agree, do not use the service.
When we publish a new version of a required policy, continued use after the effective date may require renewed acceptance.
2. Eligibility and Account Responsibility
You must be legally competent to contract under applicable law. In India, you must be at least 18 years old, or use the service only with verifiable consent of a parent or lawful guardian where required by applicable law.
You must provide accurate registration information and keep your credentials secure. You are responsible for activity that occurs under your account, except where caused by our failure to maintain reasonable security.
3. Nature of the Service
SahkaarX provides informational career exploration, skill assessment, learning recommendations, and related software features. The service may use automated systems, including artificial intelligence, to generate suggestions based on information you provide and your in-app activity.
SahkaarX does not provide legal, medical, psychological, immigration, employment, or other licensed professional advice. Outputs are informational and may be incomplete, outdated, or inaccurate. You are responsible for your own career, education, and employment decisions.
4. Acceptable Use
You agree not to:
- Use the service unlawfully or in a way that harms others or the platform.
- Attempt to access accounts, data, or systems without authorization.
- Upload malware, infringing content, or material you do not have rights to share.
- Reverse engineer, scrape, or overload the service except as permitted by law.
- Misrepresent your identity, qualifications, or submissions.
We may suspend or terminate access for violations or risks to the service or other users.
5. Learning Plans, Assessments, and Third-Party Resources
Learning plans, assessments, scores, fit indicators, and recommendations are generated for educational and planning purposes. They are not guarantees of hiring, promotion, certification, compensation, or skill mastery.
The service may link to third-party learning resources, websites, or tools. We do not control third-party content and are not responsible for their availability, accuracy, terms, or privacy practices.
6. User Content and Submissions
You retain ownership of content you submit, such as profile details, responses, task evidence, and feedback. You grant us the rights necessary to host, process, display, and use that content to operate, secure, personalize, and improve the service, consistent with the Privacy Policy and AI Usage Policy.
You represent that you have the rights needed for the content you submit.
7. Purchases and Entitlements
If paid packages, promotions, or entitlements are offered, additional commercial terms may apply at the point of purchase. Payment processing may be handled by regulated payment partners in India or other jurisdictions.
Refund and cancellation terms are described in our Refund & Cancellation Policy. Unless required by law, fees are non-refundable except as stated in that policy, applicable purchase terms, or under applicable consumer protection law.
8. Intellectual Property
The service, including software, design, branding, and curated content made available by SahkaarX, is protected by intellectual property laws. These Terms do not grant you ownership of the service or our intellectual property except for the limited right to use the service as permitted here.
9. Suspension and Termination
You may stop using the service at any time and may request account deletion where available. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the service or your account type.
10. Disclaimers
The service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, SahkaarX and its affiliates, suppliers, and licensors are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or opportunities arising from your use of the service.
Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the claim or INR 8,500, unless applicable law requires otherwise. Nothing in these Terms limits rights that cannot be limited under applicable law, including rights available to consumers in India under the Consumer Protection Act, 2019.
12. Governing Law and Disputes
These Terms are governed by the laws of India. Courts and tribunals in Ahmedabad, Gujarat, India will have exclusive jurisdiction over disputes arising out of or relating to these Terms, subject to mandatory rights available to you under applicable law.
If you are a consumer in India, you may also be entitled to remedies and forums available under applicable consumer protection law.
13. Changes to These Terms
We may modify these Terms from time to time.
Updated versions will be posted on our website and/or mobile application with a revised "Last Updated" date.
Continued use of SahkaarX after updates constitutes acceptance of the revised terms. Material changes may require renewed acceptance before continued use.
